Study shows parental alienation arguments work in court

On Behalf of Joshi, attorneys + counselors | Mar 22, 2021 | Parental Alienation

There are a lot of different tactics that parents can use during a child custody dispute. Amongst them is parental alienation. Given that focus on this form of manipulation is relatively new, a lot of parents either fail to recognize it or are unsure of how to pursue claims of parental alienation in court. Others are simply afraid that the court system will view their parental alienation argument as nothing more a strategy to avoid accusations of child abuse and neglect that has actually occurred. But this simply isn’t the case.

Study shows the success of raising parental alienation arguments

According to one recent study, the court system is actually really receptive to parental alienation arguments. There, a group of researchers looked at nearly 1,000 appellate cases where parental alienation was a focus. Their findings were promising for those who have been subjected to alienation. Their research found that parents who engage in alienating behavior end up with less parenting time. The same held true for parents who falsely alleged that they were the victims of parental alienation.

Highlighting the need for expert testimony

One of the challenges that judges face in parental alienation cases is cutting through all of the he-said, she-said to get to the truth of the matter. In most parental alienation cases, one parent accuses the other of something and the other denies it. But an expert can help provide clarity. That’s why if you’re dealing with parental alienation in your child custody case, then you might want to acquire an expert witness on your side who can help assess the situation and render an opinion that can assist the judge in reaching the right conclusion. This is probably one of the best ways to ensure that your case lines up with those appellate cases mentioned above.

Have a strong legal advocate on your side

If you want to succeed in proving parental alienation, then you need a team on your side that understands parental alienation to the fullest extent. That’s why we encourage parents to research their potential representation before choosing a law firm that they think is right for them. There are very few law firms in the country that have a firm grasp on how to handle these kinds of cases, which is why individuals turn to us time and again for assistance.
