Post Conviction Appeals

After an adverse verdict, defendants often lose heart. But accepting a guilty or adverse verdict is not always the best course of action. There may be one or more possible appellate or post-conviction strategies that could result in a new trial or reconsideration of the sentence or judgment.

Joshi conducts an active appellate practice in federal and state courts throughout the country. The firm pursues appeals, files habeas corpus petitions, and files motions to reconsider sentences on behalf of white collar criminal defendants.

Attorneys Experienced In The Court of Appeals

Joshi are experienced trial advocates with a reputation for creativity and results defending clients accused of white collar crimes. The firm’s attorneys have significant experience before the Supreme Court of the United States, most of the federal circuit courts of appeal, numerous state appellate and supreme courts, as well as specialized appellate tribunals.

Lawyers at Joshi have extensive experience in appellate and post-conviction matters on behalf of their own clients as well as those defendants who could benefit from a fresh perspective. Joshi welcomes inquiries from other law firms who wish to refer cases to the firm.

Possible Court Of Appeals Actions

Before an appeal, the firm’s lawyers will carefully review all aspects of your case. They will comb through the trial record, research case law, and consider all possible options. These options can include a petition for a new trial, or more limited relief such as a petition to revisit the sentencing.

As a potential appellant, you must realize that a new trial carries the possibility, upon conviction, of a more severe sentence. Joshi will discuss all of your options and possible outcomes, so that you can make an informed decision about how to proceed.

You Must Act Quickly

Joshi encourages counsel to consult with the firm as soon as they believe that a client may need appellate representation, preferably well before proceedings in the lower court conclude.

Individual defendants need to understand that in most jurisdictions you have only 30 days to file a notice of appeal after the judgment has been entered. Post-conviction petitions generally must be filed within one year of the verdict.
